The SFNet Guide to the Florida and Georgia Commercial Finance Disclosure Laws

We are pleased to provide our members with this Guide to assist in complying with certain commercial finance  disclosure legislation recently enacted in the States of Florida and Georgia.

While other states (notably California and New York) have implemented regulations that supplement and attempt to clarify the disclosure statutes enacted by their respective legislatures, neither Florida nor Georgia has chosen to do so.  The result is that the Florida and Georgia Disclosure Laws are often vague or insufficiently detailed in ways that may make it difficult for our members to make decisions about how to comply. However, the disclosure obligations in Florida and George are generally much less complicated. In particular, Florida and Georgia do not require any complex calculations, such as calculating a “finance charge” or APR.
